Agreement is almost always better than judgment
A court dispute costs time, money and nerves – and the outcome is uncertain. An agreement reached in mediation is, by contrast, fast, confidential and tailored to both sides. In Pardubice we conduct mediation and conciliation in all areas where negotiation makes sense.
When mediation works and when it does not
Mediation is suitable if both sides at least minimally want to find an agreement. Conversely, in case of obvious bad will, an acute danger (domestic violence) or the need for a precedent decision the court route is faster. We realistically tell you what to expect from mediation.
Settlement with enforceability
A settlement can be drafted as a notarial or executor deed with consent to enforcement – if the other side does not perform, enforcement can be initiated immediately without court proceedings.
Frequently asked questions
+How much does mediation cost?
The mediator's fee is usually paid by the parties in equal shares. The price is in the range of a few thousand CZK per session – still an order of magnitude less than the whole court dispute. For family matters the first meeting is favoured by law.
+Is the agreement from mediation binding?
Yes. If both sides sign it, it is a valid contract. For higher enforceability we recommend concluding it as a notarial or executor deed with consent to enforcement.
+Can I go to court after unsuccessful mediation?
Of course. What was said during mediation is confidential and cannot be used as evidence in court. If the court orders an initial meeting with a mediator (up to 3 hours), participation is mandatory, but the mediation itself is voluntary.
