Is your neighbour building by the fence and you mind?

As a party to the zoning and building proceedings you can file objections that the authority must address. After the new Building Act took effect (2024) the deadlines are shorter and the procedural rules stricter – early engagement of a lawyer significantly increases the chance of success.

Illegal building – legalisation or demolition

A building without a permit may be additionally permitted if it complies with the zoning plan and technical requirements. Otherwise a fine and a removal order is at risk. We assess the realistic chances of legalisation and guide you through the whole process.

Neighbour disputes – immissions and nuisance

The Civil Code protects against disproportionate immissions (noise, dust, shade, smoke). However, enforcement often means longer court proceedings – we therefore first try out-of-court negotiations and a settlement. If that fails, we go to court.

Frequently asked questions

+Can I prevent my neighbour from building a two-storey house by the fence?

If the construction complies with the zoning plan and meets the setback distances, it probably cannot be stopped altogether. However, changes can be pushed through (height, window placement, setback) that reduce the impact on your rights. The key is to file objections in time during the zoning procedure.

+What to do if a neighbour caused damage to my property?

Send a pre-litigation notice with quantification of the damage and photo documentation. If unsuccessful, we file a damages action. For more serious matters we recommend an expert opinion right at the start.

+How long does zoning and building procedure take after the 2024 amendment?

The new Building Act introduced a single permit and shorter deadlines. In practice it is realistic to obtain a permit for a family house within 3–6 months, longer for more complex buildings.
