+What form must a will take?
A holographic will must be written entirely by hand and signed. A typed will must be signed by the testator and two witnesses. A safe option is a will in the form of a notarial deed – we will prepare it together with a notary.
+Can I disinherit my descendant?
A forced heir (an adult descendant) is entitled to at least a quarter of the statutory share, a minor to three quarters. Disinheritance is possible only on statutorily defined grounds – the wording of the deed of disinheritance requires maximum care.
+What to do if the inheritance contains debts?
You can refuse the inheritance within a month after notification by the court, or reserve an inventory of the estate and thus limit liability to the value of the inherited assets. The choice must be carefully considered – we will assess it together.
